Dutch Bros Chillin with Dutch Gift with Purchase Offer Terms and Conditions

Dutch Bros Gift with Purchase Offer (“Offer”) is limited to purchases made of participating Dutch Bros products as listed below, solely for purchases made either (a) in-store or (b) via H-E-B, Albertsons, Walmart, Brookshire’s, WinCo, Safeway, Andronico’s, Vons, Pavilions, Randall’s, Tom Thumb, United Supermarkets, Market Street, and Amigos website or mobile app for in-store pick-up. Offer not valid for any Dutch Bros products purchased then shipped directly to a consumer.

In return for the opportunity to participate in the Dutch Bros Gift with Purchase Offer described herein (the “Offer”), Trilliant Food and Nutrition (“Sponsor”) requires your agreement, and you hereby agree, to comply with and be bound by the terms and conditions set forth below (the “Terms”).

PARTICIPATION CONSTITUTES THE PARTICIPANT’S FULL AND UNCONDITIONAL AGREEMENT TO, AND ACCEPTANCE OF, THESE TERMS.

To receive your Dutch Bros Coffee Tumbler (approximate retail value $15.00) by mail, purchase $20 or more (before taxes) worth of Eligible Dutch Bros product (as defined below) in a single transaction made between September 1, 2026, and September 30, 2026 (“Promotion Period”). Purchase must be made at a H-E-B, Albertsons, Walmart, Brookshire’s, WinCo, Safeway, Andronico’s, Vons, Pavilions, Randall’s, Tom Thumb, United Supermarkets, Market Street, and Amigos either (a) in-store, or (b) online or via mobile app solely for in-store pick up (not applicable for purchases delivered directly to consumer).

This Offer is limited to one (1) gift per household, regardless of the number of qualifying purchases made, and is available only while supplies of the gift last. Offer valid only for in-store purchase or in-store pick-up purchases.

Eligible Dutch Bros Products

To Redeem Offer

1. Take a photo or scanned image of your receipt/order pickup confirmation dated during the Promotion Period showing Eligible Dutch Bros product(s) and cost.
2. Visit www.chillinwithdutch.com and complete the offer form (name, address, city, state, zip code, daytime phone number, and email).
3. Upload your receipt image with Eligible Dutch Bros product(s) circled, verify clarity, and submit by 11:59:59 p.m. CT on October 15, 2026.

Offer Conditions

Offer valid only for in-store purchase or in-store pick-up purchases (not valid for any purchase shipped directly to consumer). Offer is valid only to legal residents of the Continental United States and the District of Columbia (excludes Alaska and Hawaii) who are at least eighteen (18) years of age or the age of majority in their state of residence, whichever is greater. Void in Puerto Rico, the U.S. Virgin Islands, and where prohibited, restricted, or taxed.

This Offer is not a game of chance, lottery, sweepstakes, or contest. Eligible Dutch Bros product(s) must be purchased together in a single transaction and reflected on one (1) receipt. Limit one (1) gift per household. Offer available while supplies last. All online submissions must be completed by 11:59:59 p.m. CDT on October 15, 2026.

Allow approximately four (4) to six (6) weeks for shipment following receipt verification. Replacement requests will not be considered after thirty (30) days following shipment. Offer is valid only for individual consumers; group/business/organization requests will not be honored.

Any coupon, discount, or promotional code applied to a purchase reduces the purchase total used to determine whether the $20 threshold has been met. Incomplete, damaged, photocopied, mechanically reproduced, altered, forged, invalid, duplicate, or unauthorized receipts/forms will not be accepted or returned.

By participating, Participant agrees to be bound by these terms and Sponsor decisions within Sponsor’s discretion. Released Parties are not responsible for late, lost, stolen, illegible, damaged, incomplete, misaddressed, misdirected, delayed, inaccurate, or postage-due submissions, or other errors, except where caused by gross negligence or willful misconduct.

Employees of Released Parties and immediate family/household members are not eligible. All requests become Sponsor property and are non-returnable. Sponsor has no obligation to acknowledge, redeem, or return non-compliant requests. Fraudulent postal activity and unauthorized publication/trading/selling/manufacturing of receipts or forms violate these Terms.

Indemnification

Participant shall indemnify, defend, and hold the Released Parties harmless against all losses, damages, costs, expenses (including reasonable attorneys’ fees), or liabilities arising from wrongful or negligent acts/omissions or alleged legal violations by Participant in connection with the Offer, including intellectual property claims.

Dispute and Damages Limitations

BY PARTICIPATING IN THE OFFER, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PARTICIPANTS AGREE THAT:

1. Disputes, claims, and causes of action must be resolved individually (no class, representative, or consolidated actions).
2. Claims, judgments, and awards are limited to actual out-of-pocket costs incurred, excluding attorneys’ fees.
3. Participant waives punitive, incidental, indirect, and consequential damages, and any right to multiplied/increased damages beyond actual out-of-pocket expenses.

If any provision is held unlawful, unenforceable, or void, it is modified to the minimum extent necessary, or severed if modification is not possible; remaining provisions remain in effect. Nothing limits rights/remedies that cannot be waived under applicable state law.

Trilliant Food and Nutrition collects Participant personal data in accordance with its Privacy Policy: https://trilliantfood.com/privacy-policy/. By participating, you agree to Sponsor’s collection and use of personal information and acknowledge acceptance of Sponsor’s privacy policy. Participant information may be used for direct marketing, research, and monitoring/improving product use and satisfaction.
