Dutch Bros Gift with Purchase Offer (“Offer”) is limited to purchases made of participating Dutch Bros products as listed below, solely for purchased made at H-E-B, Albertsons, Walmart, Brookshire’s, WinCo, Safeway, Andronico’s, Vons, Pavilions, Randall’s, Tom Thumb, United Supermarkets, Market Street, Amigos or Amazon.

In return for the opportunity to participate in the Dutch Bros Gift with Purchase Offer described herein (the “Offer”), Trilliant Food and Nutrition (“Sponsor”) requires your agreement, and you hereby agree, to comply with and be bound by the terms and conditions set forth below (the “Terms”).

To receive your Dutch Bros Coffee Tumbler (approximate retail value $15.00) by mail, purchase $20 or more (before taxes) worth of Eligible Dutch Bros product (as defined below) in a single transaction made between September 1, 2026, and December 31, 2026 (“Promotion Period”). To be eligible, purchase must be made at H-E-B, Albertsons, Walmart, Brookshire’s, WinCo, Safeway, Andronico’s, Vons, Pavilions, Randall’s, Tom Thumb, United Supermarkets, Market Street, Amigos or Amazon.

Eligible Dutch Bros products:

Take a photo of your H-E-B, Albertsons, Walmart, Brookshire’s, WinCo, Safeway, Andronico’s, Vons, Pavilions, Randall’s, Tom Thumb, United Supermarkets, Market Street, Amigos or Amazon sales receipt showing your Eligible Dutch Bros products, dated during the Promotion Period, or create a scanned image of the receipt, showing your purchase of Eligible Dutch Bros product(s) and their cost.

Visit www.chillinwithdutch.com, and complete the offer form, including your name, address, city, state, zip code, daytime phone number (area code included), and email address; and

Upload your image of the original sales receipt with Eligible Dutch Bros product(s) circled. Review your uploaded image for clarity (illegible images will not be accepted) and click Submit. Online submissions must be completed by 11:59:59 p.m. CT, January 15, 2027, to be eligible.

Offer conditions: Offer is valid only to legal residents of the Contiguous United States (excludes Alaska and Hawaii) who are at least eighteen (18) years of age or the age of majority in their state of residence, whichever is greater. Void in AK, HI, Puerto Rico, the U.S. Virgin Islands, and where prohibited, restricted, or taxed. This Offer is not a game of chance, lottery, sweepstakes, or contest. Eligible Dutch Bros product(s) must be purchased together in a single transaction at a H-E-B, Albertsons, Walmart, Brookshire’s, WinCo, Safeway, Andronico’s, Vons, Pavilions, Randall’s, Tom Thumb, United Supermarkets, Market Street, Amigos or Amazon. and reflected on one (1) receipt. Limit one (1) gift per household. Offer is available only for Eligible Dutch Bros product(s) actually purchased from a H-E-B, Albertsons, Walmart, Brookshire’s, WinCo, Safeway, Andronico’s, Vons, Pavilions, Randall’s, Tom Thumb, United Supermarkets, Market Street, Amigos or Amazon and eligible for redemption while supplies of the gift last. All online submissions must be completed by 11:59:59 p.m. CDT on January 15, 2027.

Allow approximately four (4) to six (6) weeks for shipment of the gift following receipt and verification of all required documentation. Replacement requests, for any reason, will not be considered after thirty (30) days following shipment. Offer is valid only for individual consumers (“Participant(s)”); requests from groups, businesses, clubs, or organizations will not be honored. Any coupon, discount, or promotional code applied to a purchase will reduce the purchase total used to determine whether the $20 purchase threshold has been met for purposes of this Offer. Incomplete, damaged, photocopied, mechanically reproduced, altered and/or forged receipts or offer forms of any kind, or receipts or offer forms not obtained through authorized channels, will not be accepted (except as specifically provided herein for online submissions). Invalid or duplicate requests will not be honored or returned.

By participating, Participant agrees to be bound by these terms and the decisions of Sponsor, which are final and binding on matters within Sponsor's discretion under these Terms, without limiting any rights a Participant may have under applicable law. Dutch Bros, Trilliant Food and Nutrition, and their respective parents, affiliates, and subsidiaries (collectively, “Released Parties”) are not responsible for late, lost, stolen, illegible, damaged, incomplete, misaddressed, misdirected, delayed, inaccurate, or postage-due mail, or for any errors of any kind relating to this Offer, except to the extent caused by the gross negligence or willful misconduct of a Released Party. Employees of the Released Parties, including affiliates and agents, and immediate family members and/or those living in the same household as such employees, are not eligible to participate in this Offer. All requests become the property of Sponsor and are non-returnable. Sponsor has no obligation to acknowledge, redeem, or return requests not in compliance with these Official Rules. The U.S. Postal Service statutes prohibit acts devised to defraud or to obtain money or property by false or fraudulent means if the postal system is involved, including, among other things, the use of fictitious names or addresses. Participant shall indemnify, defend, and hold the Released Parties harmless against any and all losses, damages, costs, expenses (including reasonable attorneys’ fees), or any other liability, which any of them may incur or for which any of them become liable, arising out of the wrongful or negligent acts or omissions of or alleged violations of law by participant in connection with the Offer, including claims arising from or related to actual or alleged infringement or misappropriation of any patent, trademark, copyright, trade secret, or any actual or alleged violation of any other intellectual property or proprietary rights arising from or in connection with the Participant’s participation in the Offer.

BY PARTICIPATING IN THE OFFER, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PARTICIPANTS AGREE THAT: ( 1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE OFFER, OR ANY GIFT AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS, REPRESENTATIVE, OR CONSOLIDATED ACTION; ( 2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH PARTICIPATING IN THE OFFER, BUT IN NO EVENT ATTORNEYS’ FEES; AND ( 3) PARTICIPANT WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES AND ANY RIGHT TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES. IF ANY COURT OR TRIBUNAL OF COMPETENT JURISDICTION HOLDS THAT ANY PROVISION OF THIS PARAGRAPH IS UNLAWFUL, UNENFORCEABLE, OR VOID UNDER THE LAW OF A PARTICIPANT'S STATE OF RESIDENCE, THAT PROVISION SHALL BE DEEMED MODIFIED TO THE MINIMUM EXTENT NECESSARY TO MAKE IT ENFORCEABLE, OR IF IT CANNOT BE SO MODIFIED, SEVERED, AND ALL REMAINING PROVISIONS OF THESE TERMS SHALL REMAIN IN FULL FORCE AND EFFECT. NOTHING IN THIS PARAGRAPH LIMITS ANY RIGHT OR REMEDY THAT CANNOT BE WAIVED AS A MATTER OF LAW IN A PARTICIPANT'S STATE OF RESIDENCE.
